These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Saymarine Denizcilik Teknolojileri San. Tic. Ltd. ("Saymarine," "we," "us," or "our"), a company registered in the Republic of Turkey. These Terms govern your use of the Ancwhis mobile application (the "App"), the Ancwhis IoT hardware device (the "Device"), and any related cloud services, firmware, and updates (collectively, the "Services").
By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
These Terms are drafted primarily for users in Türkiye, the European Economic Area, Switzerland, California, Thailand, and Indonesia. If mandatory consumer, contract, unfair terms, digital content, subscription, or platform law in your place of residence grants you rights that cannot lawfully be waived or limited, those mandatory rights will prevail to the extent of any conflict.

1. Service Description
Ancwhis is a smart anchor monitoring system that combines purpose-built IoT hardware with a mobile application to provide:
- Real-time GPS vessel position tracking
- Intelligent anchor drag detection and instant alerts
- Battery and system health monitoring
- Multi-user device sharing (owner/viewer roles)
- Historical position and status data
The Device communicates with the App through cloud-based IoT infrastructure (AWS IoT Core). The Services require an active internet connection on both the Device (Wi-Fi or cellular) and the User's mobile device.
2. Important Maritime Safety Notice
THE ANCWHIS SYSTEM IS A SUPPLEMENTARY MONITORING AID AND DOES NOT REPLACE PROPER SEAMANSHIP, WATCH-KEEPING, ANCHOR WATCH DUTIES, OR ESTABLISHED NAVIGATION PRACTICES. YOU REMAIN SOLELY AND FULLY RESPONSIBLE FOR THE SAFETY OF YOUR VESSEL, CREW, PASSENGERS, AND CARGO AT ALL TIMES.
You expressly acknowledge and agree that:
- The Ancwhis system is not certified under IMO, SOLAS, COLREGS, MARPOL, or any other international or national maritime regulatory framework
- The system does not replace authorized charts, nautical publications, radar, AIS, VHF, or any other legally mandated navigational equipment
- GPS accuracy is subject to environmental factors (satellite geometry, atmospheric conditions, obstructions) and may vary. Position data should always be verified through independent means
- The system relies on internet connectivity and power supply. Service interruptions may occur due to network issues, hardware malfunction, or environmental conditions
- You must comply with all applicable maritime laws, regulations, and standards in your jurisdiction, including but not limited to local anchoring restrictions, port authority rules, and environmental regulations
- Marine electronics, including the Ancwhis system, are aids to situational awareness — never a substitute for proper seamanship
3. Eligibility & Account
To use the Services, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Provide accurate, complete, and current registration information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account. Device ownership transfer must be coordinated through Saymarine support (info@saymarine.com) to ensure proper de-provisioning and re-provisioning of security certificates.
4. License & Acceptable Use
Subject to your compliance with these Terms, Saymarine grants you a limited, non-exclusive, non-transferable, revocable license to use the App and Services for personal, non-commercial purposes.
You agree not to:
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App or firmware
- Modify, adapt, or create derivative works based on the Services
- Remove, alter, or obscure any proprietary notices, labels, or marks
- Use the Services for any unlawful, fraudulent, or harmful purpose
- Interfere with, disrupt, or place an undue burden on our servers or infrastructure
- Attempt to gain unauthorized access to other users' accounts or data
- Use automated systems (bots, scrapers) to access the Services
- Sublicense, sell, resell, or commercially exploit the Services without our written consent
- Tamper with, disassemble, or modify the Ancwhis hardware device in any way that may affect its safety, waterproofing, or functionality
5. Intellectual Property
All right, title, and interest in and to the Services — including but not limited to the App, firmware, hardware design, cloud infrastructure, algorithms, user interface design, graphics, logos, and all associated intellectual property — are and shall remain the exclusive property of Saymarine.
"Ancwhis" and "Saymarine" are registered trademarks of Saymarine Denizcilik Teknolojileri San. Tic. Ltd. Unauthorized use of our trademarks is strictly prohibited.
These Terms do not grant you any right, title, or interest in the Services except for the limited license described in Section 4.
6. Subscriptions & Payments
Certain features of the Services may require a paid subscription. Subscription terms, pricing, and available plans are displayed within the App.
- Subscriptions are billed through the Apple App Store or Google Play Store
- Subscriptions automatically renew unless cancelled before the end of the current billing period
- Refunds, credits, or proration are handled under the applicable platform's policies and any mandatory law that applies to your purchase (Apple / Google)
- You may cancel your subscription through your Apple ID or Google Play account settings at any time
- Cancellation normally takes effect at the end of the current billing period, except where applicable law or platform policy requires a different result
For consumers, pricing disclosures, taxes, renewal timing, billing mechanics, and cancellation flow may also be governed by the rules of the Apple App Store, Google Play Store, and mandatory local law in your place of residence.
If you are entitled to non-waivable digital content or subscription rights under applicable law, nothing in these Terms limits any mandatory pre-contract information, withdrawal, cancellation, refund, conformity, repair, replacement, price reduction, or equivalent statutory remedy available to you. Where the law requires prior consent or acknowledgement before digital performance starts during a withdrawal period, we or the relevant platform may request that consent or acknowledgement.
7. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Saymarine expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Services will be uninterrupted, error-free, timely, secure, or free from viruses or other harmful components
- Any warranty regarding the accuracy, completeness, or reliability of GPS data, position information, or anchor status alerts
- Any warranty that the Services will meet your specific requirements or expectations
Nothing in these Terms excludes, restricts, or replaces any statutory guarantee, consumer warranty, or remedy that cannot lawfully be excluded under applicable law.
You acknowledge that the maritime environment presents unique challenges (extreme weather, electromagnetic interference, satellite signal degradation, power interruptions) that may affect the performance of any electronic system, including the Ancwhis system. You use the Services at your own risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND SUBJECT TO ANY NON-EXCLUDABLE RIGHTS OR REMEDIES AVAILABLE TO YOU:
- SAYMARINE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION
- THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE), EVEN IF SAYMARINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
- SAYMARINE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF: (a) THE AMOUNT YOU ACTUALLY PAID TO SAYMARINE FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED UNITED STATES DOLLARS (US$100.00)
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including for fraud, intentional misconduct, gross negligence where non-excludable, or death or personal injury caused by negligence where the law does not permit exclusion.
The above limitations may not apply in jurisdictions that do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, Saymarine's liability shall be limited to the fullest extent permitted by applicable law.
Maritime risk allocation: Because the Services are a supplementary aid and not a certified navigation or safety system, you remain responsible for seamanship decisions and for maintaining independent safeguards. This allocation of responsibility does not limit any liability that cannot lawfully be limited under applicable law.
9. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Saymarine, its directors, officers, employees, affiliates, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Any claim by a third party relating to your use of the Services
This Section does not apply to the extent a claim results from our own breach, negligence, unlawful conduct, or a non-waivable consumer protection right available to you.
10. Termination
We may suspend or terminate your access to the Services for the following reasons and subject to any notice, refund, or other remedy required by applicable law or platform terms:
- Violation of these Terms
- Fraudulent, abusive, or unlawful activity
- Non-payment of subscription fees
- Extended period of account inactivity (12 months or more)
- Legitimate business, legal, product integrity, or security reasons, subject to any notice, refund, or other remedy required by applicable law or platform terms
You may terminate your account at any time by using the "Delete Account" feature in the App or by contacting us. Upon termination:
- Your license to use the Services is immediately revoked
- You must cease all use of the App and Services
- We will delete your personal data in accordance with our Privacy Policy
- Provisions that by their nature should survive termination shall survive (including Sections 5, 7, 8, 9, and 12)
If you are a consumer, we will not rely on this Section to override any non-waivable notice, refund, portability, or other remedy rights available under applicable law or platform rules.
11. Apple & Google Platform Terms
If you access the App through the Apple App Store or Google Play Store, the following additional terms apply:
a) General
- These Terms are between you and Saymarine only, and not with Apple Inc. ("Apple") or Google LLC ("Google")
- Saymarine, not Apple or Google, is solely responsible for the App and its content
b) Apple App Store
- The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
- Saymarine, not Apple, is responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App
- Saymarine is responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App
- Saymarine, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Saymarine, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof
c) Google Play Store
- You acknowledge that Google has no obligation or liability to you with respect to the App
- You must comply with applicable Google Play Terms of Service when using the App
12. Governing Law & Dispute Resolution
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules, except to the extent mandatory law in your country or state of residence applies and cannot lawfully be excluded.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved as follows, subject always to non-waivable consumer or data protection rights:
- Informal resolution — The parties shall first attempt to resolve any dispute informally by contacting info@saymarine.com. We will endeavor to resolve disputes within a commercially reasonable time and, where applicable law sets a specific consumer-handling deadline, within that deadline.
- Consumers — If you use the Services as a consumer, nothing in these Terms prevents you from relying on mandatory consumer protection law, bringing a claim before the courts or authorities that local law makes available to you, or using any statutory alternative dispute resolution process available in your place of residence. We do not require binding pre-dispute arbitration where applicable law does not allow it.
- Business users — If you use the Services in the course of a trade, business, or profession, and local mandatory law does not require another forum, disputes not resolved informally shall be finally settled by arbitration under the rules of the Istanbul Arbitration Centre (ISTAC), with the seat of arbitration in İstanbul, Türkiye.
- Interim relief — Either party may seek temporary or injunctive relief from a court of competent jurisdiction to protect confidential information, intellectual property, or security interests.
Nothing in these Terms deprives any consumer of mandatory rights under the laws of their country, state, or province of residence, including any right to bring proceedings before local courts, consumer authorities, or data protection authorities where such a right exists by law.
13. Force Majeure
Saymarine shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather events, or acts of God
- War, terrorism, civil unrest, or government actions
- Pandemics, epidemics, or public health emergencies
- Failure of telecommunications, internet, or satellite infrastructure
- Power outages, hardware failures, or cyberattacks
- Disruptions to third-party services (AWS, Apple, Google) on which the Services depend
14. Severability & Entire Agreement
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Saymarine with respect to the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
Waiver: No failure or delay by Saymarine in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. Saymarine may assign its rights and obligations under these Terms without restriction.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes:
- We will update the "Last updated" date at the top of this page
- We will notify you via in-app notification or email for significant changes
- We will post the updated Terms on this page
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and delete your account.
Where applicable law requires advance notice, express acceptance, or a right to cancel following a material change, we will follow those requirements.
